法律分析：两罪的犯罪主体、主观方面都相同，皆属故意犯罪。两罪侵犯的客体不尽相同，其同类客体都是对环境资源保护和管理制度的侵犯，只是犯罪所侵犯的直接客体有所不同，非法狩猎罪所侵犯的客体为国家保护野生动物资源的管理制度;而非法猎捕、杀害珍贵、濒危野生动物罪所侵犯的客体为国家对珍贵、濒危野生资源的重点保护制度。两罪的主要区别是：(1)犯罪客观方面不同。非法狩猎罪主要表现为在禁猎区、禁猎期或使用禁用工具、方法实施的狩猎行为，且情节严重的才构成犯罪;而非法猎捕、杀害珍贵、濒危野生动物罪则表现为非法猎捕、杀害珍贵、濒危野生动物的行为，行为人只要客观上对国家重点保护的珍贵、濒危野生动物实施了非法捕杀行为，即可构成犯罪，不受任何“禁止性”条件和情节是否严重的限制。(2)犯罪对象不同。非法狩猎罪的犯罪对象主要是指珍贵、濒危野生动物以外的一般陆生野物;而非法猎捕，杀害珍贵、濒危野生动物罪的犯罪对象为《国家重点保护野生动物名录》的珍贵、濒危野生动物，既包括陆生的野生动物，也包括水生的野生动物。
